The Impact of the General Data Protection Regulation (GDPR) on Innovation
The EU General Data Protection Regulation (GDPR) which recently come into force replacing the former EU Directive 95/46/EC on data protection will have a major impact on the our digital environment and economies. As a regulation it does not only bring in novel features and rights such as the ‘Right to data portability’ or ‘Right to erasure’ providing consumers with control of their personal data but also, unlike the directive, increases harmonisation of data protection law across all EU member states. The GDPR changes how the personal data of EU citizens is gathered and processed where failure to comply can lead to large fines. Within this context of a changing digital landscape, my project aims to analyse the impact on the GDPR on innovation. This falls within the general debate regarding the impact of regulations on innovation.
